Terms of Service

1. Acceptance of Terms

By accessing or using Analyze My Teeth ("the Service"), available at analyzemyteeth.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service. Your continued use of the Service constitutes acceptance of any updates or modifications to these Terms.

The Service is intended for users who are at least 18 years old. If you use the Service for another person's imaging data, you are responsible for having the legal authority and consent required to do so.

2. Nature of the Service — NOT Medical Advice

The Service is an informational and educational tool only. It is not a medical device, diagnostic tool, or healthcare provider. The Service does not provide medical advice, medical diagnoses, treatment recommendations, or clinical decision support.

All outputs generated by the Service, including but not limited to AI-generated analysis text, annotations, measurements, grading scores, reports, and consensus summaries (collectively, "Outputs"), are produced by artificial intelligence models and are provided solely for informational and educational purposes. Outputs may contain errors, inaccuracies, omissions, or hallucinated information.

You must not rely on any Output as a substitute for professional medical judgment. Always seek the advice of a qualified physician, radiologist, or other licensed healthcare professional with any questions regarding a medical condition, diagnosis, or treatment. Never disregard professional medical advice or delay seeking it because of information obtained through the Service.

3. No Doctor-Patient Relationship

Use of the Service does not create a doctor-patient relationship, therapist-patient relationship, or any other professional healthcare relationship between you and Analyze My Teeth, its operators, contributors, or affiliates. The Service is not a licensed healthcare provider and does not practice medicine in any jurisdiction.

4. Assumption of Risk

You acknowledge and agree that:

• AI-generated analysis is inherently imperfect, experimental, and may produce incorrect or misleading results.
• The Service has not been validated or approved by any regulatory body (including the FDA, EMA, or equivalent authorities) for clinical or diagnostic use.
• You use the Service entirely at your own risk and assume full responsibility for any decisions made based on the Outputs.
• The Service is not intended to replace professional radiological interpretation or clinical decision-making.

5. Data Privacy & Local Storage

Your conversation history is stored locally in your browser using IndexedDB. We do not store, transmit, or retain your chat conversations on any server.

Uploaded medical images are processed statelessly. The server receives only the rendered images and text needed for AI analysis, relays them to the AI providers for processing, and does not store them in any database, file store, or temporary directory. We do not retain copies of your medical images after the analysis request completes.

When you run an analysis, rendered images are transmitted to third-party AI providers (OpenAI, Google, Anthropic, xAI) for processing. This processing is governed by those providers' own terms, and their AI outputs are provided "as is", without warranty, and must not be relied upon as professional medical advice.

After legal consent, the Service may use privacy-preserving product analytics and session replay to improve usability. User-entered free text, patient identifiers, filenames, DICOM metadata, and rendered medical images are masked or excluded from analytics. Product UI and AI-generated response text may remain visible in recordings, and analytics are not used for advertising, remarketing, or cross-site profiling.

6. User Responsibilities

You agree to:

• Use the Service only for lawful, personal, informational, and educational purposes.
• Not use the Service as a basis for clinical decisions without independent verification by a qualified healthcare professional.
• Not upload imaging data for which you do not have proper authorization or consent.
• Use the DICOM anonymization tool if uploading data that contains Protected Health Information (PHI) and you wish to remove it.

7. Payments, Credits and Pricing

Browsing Analyze My Teeth, opening imaging in the viewer, and using the DICOM anonymization tool are free. Running an AI analysis requires an analysis credit.

• One credit covers a single analysis session, including every imaging series you have uploaded in that session. Adding further imaging to a session that has already been charged does not cost another credit.
• Prices, including any bulk pricing, are shown before you pay. Payments are charged in Ukrainian hryvnia (UAH), converted from the displayed price at the exchange rate applied at checkout.
• Card payments are processed by Monobank. We never receive or store your full card number, expiry date, or security code.
• Credits are personal to your browser session, are not transferable, and have no cash value except as a refund under section 8.
• Credits are valid for 365 days from the date of purchase. After that period we may treat them as expired, and they can no longer be refunded.
• Credits awarded at no cost, for example through a share or feedback reward, are not purchased credits. They carry no monetary value and cannot be refunded.

8. Refunds

You can request a refund from within the Service, under Settings, in the Purchases section. No email or account is required.

• A purchase can be refunded within 30 days of the date of purchase, provided none of the credits from that purchase have been used.
• Because a credit is consumed only once an analysis report has been successfully produced, a payment that never resulted in a report remains refundable.
• While a request is open, the credits from that purchase are held and cannot be spent. If the request is declined they are returned to your balance immediately.
• Requests are reviewed individually. Approved refunds are returned to the card used for the original payment, for the amount actually paid, through Monobank. Your bank may take several working days to show the funds.

If something went wrong that is not covered above, get in touch and we will look at it. This refund policy is offered in addition to, and does not limit, any rights you have under applicable consumer protection law.

9. Immediate Supply and Right of Withdrawal

Analysis credits are digital content supplied immediately. By completing a purchase you expressly request that we begin supplying the credits at once, before any statutory withdrawal period has expired, and you acknowledge that you lose any statutory right of withdrawal in respect of a credit once it has been used to produce an analysis report.

Credits you have not used remain refundable under section 8. Where applicable law grants you rights that cannot be waived by agreement, those rights continue to apply and nothing in these Terms limits them.

10. Payment Disputes and Chargebacks

If you believe a charge is wrong, please contact us before asking your bank to reverse it. Use the refund request in Settings, or write to us directly. We aim to respond within three working days, and where a refund is due we will pay it without requiring you to open a dispute.

We keep a record of each purchase, including the invoice reference, the amount, and whether an analysis report was produced, so that a disputed payment can be checked against what the Service actually delivered.

Nothing in this section limits your right to contact your bank or card issuer, or any right available to you under the rules of your card scheme or applicable law.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Outputs will be accurate, reliable, complete, or error-free, or that the Service will be uninterrupted, timely, secure, or free of defects.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ANALYZE MY TEETH, ITS OPERATORS, DEVELOPERS, CONTRIBUTORS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, HEALTH DETERIORATION, PERSONAL INJURY, MISDIAGNOSIS, DELAYED TREATMENT, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE OR ANY OUTPUTS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless Analyze My Teeth, its operators, developers, contributors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to your use of the Service, your reliance on any Outputs, or your violation of these Terms.

14. Third-Party AI Services

The Service uses third-party AI models (including models from OpenAI, Google, Anthropic, and xAI) via API. These third-party services have their own terms of service and privacy policies. We are not responsible for the accuracy, availability, or behavior of third-party AI models. Your uploaded images may be transmitted to these third-party AI providers for analysis processing.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms. It is your responsibility to review these Terms periodically.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of Ukraine, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of Ukraine. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer law in your country of residence.

17. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

18. Intellectual Property

The Service, including its design, code, user interface, and documentation, is the intellectual property of its operators and is protected by applicable copyright and intellectual property laws.

AI-generated Outputs are provided to you for your personal, non-commercial, informational use. You may share Outputs with your healthcare providers. We make no claim of ownership over user-uploaded content. You retain all rights to your medical imaging data.

19. Termination

We reserve the right to suspend or terminate your access to the Service at any time, for any reason, without notice or liability. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) shall survive.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

21. Entire Agreement

These Terms, together with the Privacy Policy and Medical Disclaimer, constitute the entire agreement between you and Analyze My Teeth regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
